General Terms and Conditions for GoldenKey Suites

1. Contracting Parties and Conclusion of Contract

These General Terms and Conditions apply to all contracts for the provision of apartments and flats (GoldenKey Suites) for short-term accommodation (short-term rental) concluded between Michelle Chiva UG (the operator) and a third party (the guest).

Your rental agreement for the GoldenKey Suites comes into effect as soon as we confirm your booking by email. Offers are non-binding and subject to change. The operator is free to refuse to conclude a lodging contract at their own discretion.

2. Use and Rental Period

The suites are rented exclusively as short-term rentals for a maximum of 30 days. Subletting, commercial use, or any other use that goes beyond private accommodation is prohibited. Please observe the house rules, which are part of these terms. These include, in particular, the strict smoking ban and the avoidance of noise.

3. Guest Registration Obligation

We are legally required to collect your data in accordance with the German Federal Registration Act (Bundesmeldegesetz). For this purpose, we will provide you with an online or written form. This must be completed and signed by you no later than the day of your arrival.

4. Occupancy Sensors, Security

Occupancy sensors are installed in the suites. These devices do not record video or audio. They serve solely for security and detect disturbances such as cigarette smoke, excessive noise, and excessive temperatures or humidity. In the event of an alarm, we reserve the right to call in a service provider to clarify the situation. If you are culpably responsible for causing such an alarm, you must bear the resulting costs. You agree to this measure.

5. Smoking Ban

A strict smoking ban applies in all suites. This applies to all types of smoking, including e-cigarettes, hookahs, tobacco heaters, and similar devices.

Should you violate this rule, we reserve the right to charge you a cleaning fee of at least €200. If smoking causes higher costs or loss of income (e.g., if the apartment cannot be re-rented immediately), we must also charge you for these costs. However, you are entitled to prove that the damage was less.

6. Pets

Pets are not permitted in our suites. Approved exceptions are guide dogs for the blind, hearing dogs, and service dogs. Please provide us with the relevant proof before your arrival.

Should we find an unregistered pet in an apartment, we will charge you a special cleaning fee of at least €200. We also reserve the right to cancel the booking and evict you from the premises in this case, without any entitlement to a refund. However, you can prove that no or less damage was incurred by us.

7. Electronic Access

You will receive your access code for the electronic lock by email or via the booking platform no later than one day before arrival. A 24-hour door-opening service is available for emergencies. If you require the emergency service due to your own fault, you are responsible for the costs.

8. Check-in and Check-out

Your suite is available from 3:00 PM on the day of arrival. Check-out must take place by 10:00 AM on the day of departure. Different times are only possible by prior arrangement and for a surcharge.

9. Rental Price, Cleaning, and Utilities

The rental price depends on the number of nights and people and must be paid as stated in your booking confirmation. The price includes all utilities (electricity, water, internet), bed linen, and towels. Additionally, there is a final cleaning fee of €60.00 per stay. For bookings of more than 7 days, an interim cleaning may be mandatory, depending on the suite and the number of people.

10. Payment Terms

Payment terms depend on the booking platform. For direct bookings, a deposit of 50% is due within 7 days of the booking confirmation. The remaining amount must be paid up to two weeks before arrival. For last-minute bookings (less than 14 days before arrival), the entire amount is due immediately.

11. Cancellation and Right of Withdrawal

You can cancel your booking according to the following conditions. For direct bookings, the following applies:

  • Cancellation more than 30 days before arrival: 0% cancellation fee

  • Cancellation up to 30 days before arrival: 100% cancellation fee

A statutory right of withdrawal does not exist, as this is a service in the field of accommodation. In the event of a no-show without prior cancellation, we can re-rent the suite after 24 hours and retain the entire payment. In the event of early departure, there will be no refund for the unused nights.

12. Guest Obligations

You and your fellow travelers must observe the house rules and treat the suite and its inventory with care. Upon departure, the apartment must be left swept clean, the dishwasher must be emptied, and the rubbish disposed of.

13. Liability

You are fully liable for all damages you cause during your stay. We are liable for personal injury and property damage resulting from an intentional or grossly negligent breach of duty on our part. Our liability is limited to foreseeable, typical damages. We assume no liability for the loss or destruction of your personal belongings. There is no entitlement to a price reduction for short-term failures of public utilities (electricity, water) or in the event of force majeure.

14. Customer Data

For booking and communication, you must provide us with your email address and mobile phone number. At check-in, we also require a digital copy of a valid identification document. For German guests, this is a personal ID card or passport; for foreign guests, it is a passport. Should the documents be missing or invalid, we reserve the right to cancel the booking.

15. Internet

Wi-Fi and Smart TV

We provide you with free Wi-Fi and Smart TVs. Please note that we do not guarantee an uninterrupted connection. We assume no liability for failures (e.g., due to maintenance or technical problems).

Internet use is at your own risk. We are not responsible for security risks such as viruses or unencrypted data transmission. Please protect your devices yourself, for example, with a firewall and antivirus software.

What you must not do:

  • Illegally download or distribute copyrighted content (films, music).

  • Use illegal streaming services.

  • Upload or retrieve criminal content.

  • Infringe upon the rights of third parties (data protection, copyrights).

Should a third party make a claim against us due to any of your unlawful actions, you are obliged to indemnify us against all claims for damages and costs.

Do not share the access data with third parties. In the event of a violation, you are liable for all damages. We reserve the right to immediately block internet access or block certain websites in the event of a violation.

By using the internet, you agree to these rules.

16. Notification of Defects and Complaints

Should you discover any defects upon your arrival, you must inform us immediately so that we can remedy them as quickly as possible. We cannot take later complaints into consideration.

17. Other Provisions

  • Number of Guests: Additional overnight guests must be registered with us in advance and require our consent.

  • Access to the Rental Property: We reserve the right to enter the suite in necessary situations (e.g., for repairs). We will endeavor to inform you in advance. In the event of violations of the terms of use, we can terminate the tenancy without notice.

  • Our data protection regulations apply.

  • Severability Clause: Should a provision of these General Terms and Conditions be invalid, the validity of the remaining provisions will remain unaffected. The place of jurisdiction is Augsburg.
